Concerning collecting charges on containers held by any regulatory authority or police authority inside Damietta port authority yards located in the custom's area in Damietta port whether they are import or export in case of proven violation.

Admiral Chairman of Damietta Port Authority after reviewing
Law No. 354 of 1956 on the prohibition of entering the custom's area in ports and airports;
Law of Public Bodies Act No. 61 of 1963;
Law No. 12 of 1964 setting up the Egyptian General Establishment for Maritime Transport;
Law No. 8 of 1990 on the issuance of the Egyptian Trade Law
Law No. 81 of 2016 promulgates the civil service law and its executive regulations;
Presidential Decree No. 317 of 1985 regarding the establishment of Damietta Port Authority and its amendments;
Presidential Decree No. 399 of 2004 concerning the establishment of the Egyptian Authority for the Safety of Navigation;
Presidential Decree No. 110 of 2000 on granting the chairmen of port authorities the authority of administrative supervision over all the agencies operating inside the ports;

Minister of Transport decision No. 800 of 2016 to issue a regulation regulating the activities and works related to maritime transport and the use of it;
Damietta Port Authority Memorandum No. (5/2/2018) concerning collecting charges on containers held by any regulatory authority or police authority inside Damietta port authority yards located in the custom's area in Damietta port whether they are import or export in case of proven violation;
Board of Directors of Damietta Port Authority decision No. (5/2/2018) in its second session held on 8/03/2018 regarding collecting charges on containers held by any regulatory authority or police authority inside Damietta port authority yards located in the custom's area in Damietta port whether they are import or export in case of proven violation and approved by the Minister of Transport on 08/04/2018
has decided:

Article 1

Extra charges will be applied on containers held by any regulatory authority or police authority inside Damietta port authority yards located in the Custom's area at Damietta port whether they are import or export in case of proven violation according to the following categories:

1. The extra charges will be applied on these containers from the gated in the yard and according to the tariffs of DCHC in USD at the Central Bank of Egypt USD daily rate on each container with the account of the break day as a day the storage rate will apply on containers if they are import or export as follows:

20 feet container: USD 4.00 per day
40 feet container: USD 7.00 per day.

2. The a/m amount should be paid by the shipping line, its local agent (in case of no shipper or consignee) before containers gate out the yard and it's not allowed for any container to gate out from yards before settlement of all requested amounts.

Article 2

In additional to the a/m storage costs, the cost of lift on/off and transportation of those containers should be paid before they gate out.

Article 3

The Damietta Port Authority's IT department carries out an application in which each container is registered with its number, customs clearance and the customer's name until the date of release the container whether the release by a decision of the court or by a police authority.

Article 4

The operation center of Damietta Port Authority (Camera Control Section) records a daily statement of container traffic from / to the designated yards for this purpose.

Article 5

These containers shall be guarded by the General Department of Security in Damietta Port Authority, beside the Police and Customs Guard.

Article 6

10% of the storage revenue of the containers shall be paid to the employees who collect the amounts due on those containers.

Article (7)

This decision shall be published in the official newspaper.
